Partner Visa Subclass 309/100 (Offshore)
The Partner Visa Subclass 301/100 is a two stage visa appeal that allows de facto partners or spouses of Australian citizens, permanent residents, or eligible New Zealand citizens to permanently live in Australia. For this visa, you need to apply for the temporary Partner (Provisional) Visa (Subclass 309) and Partner (Permanent) Visa (Subclass 100) visa at the same time. Once you are granted your temporary Subclass 309 visa, you will be allowed to reside in Australia for a certain period of time until the result of your permanent Subclass 100 visa is decided. You must be an offshore applicant and can only apply for this visa if you are not in Australia.
New Zealand Citizen Family Relationship (Temporary) Visa (Subclass 461)
The New Zealand Family Relationship (Temporary) Visa under Subclass 461 is a temporary visa that allows you to stay for up to 5 years in Australia with your New Zealand family member or partner. To be able to apply for this visa, your New Zealand family member or partner must either hold a Subclass 444 visa or be eligible to hold this visa. This visa is for a person who is not a New Zealand citizen but is a member of a family unit of a New Zealand citizen. It lets you live and work in Australia for five years.

The Partner (Provisional) Visa (Subclass 309) is a temporary visa that lets offshore applicants who are de facto partners or spouses of an Australian citizen, Australian permanent resident or eligible New Zealand citizen live in Australia temporarily. This is the first stage in the two stage partner visa appeal and also the first step towards a permanent Partner visa (Subclass 100). This visa allows you to stay in Australia temporarily until the Australian government has decided the outcome of the permanent stage Partner (Permanent) Visa (Subclass 100) of your visa application. Eligibility criteria for a Partner (Provisional) Visa under Subclass 309 1. You must be outside Australia at the time of applying. 2. You must be in a genuine relationship with an Australian citizen, permanent resident, or eligible New Zealand citizen who is willing to sponsor you. 3. You must meet the requirements for a "de facto" partner if you are not married. 4. You must be over 18 years of age (except in particular circumstances.) 5. You must meet all health and character requirements. 6. You must have no outstanding debts to the Australian government. 7. You must not have had a visa canceled or application refused. Privileges linked with Partner (Provisional) Visa (Subclass 309) • Right to remain in Australian until a decision has been made about your permanent Partner visa. • Allowed to work in Australia. • Allowed to study in Australia, but with no access to government funding for tertiary study. • Can be a part of Australia’s scheme for health-related care and expense, by enrolling in Medicare.
