To apply for a Skilled Visa, individuals have to present a Skill Select Visa application which is an online application process set forth by the Department of Immigration and Border Protection for international workers. The process includes the submission of an Expression of Interest (EOI) via SkillSelect. This is followed by the actual nomination procedure conducted by the Australian employers, State and Territory Governments, or the Australian government itself. In a skill-based migration visa appeal, there are a few visa types that you can be nominated for. The potential Skill Migration visas that an individual may be chosen for under Skill Select comprise the Skilled Independent Visa under subclass 189, State Nominated Visa under subclass 190, and the Regional Sponsored Visa under subclass 489. Skilled Independent Visa (Subclass 189)

The Skilled Regional (Provisional) visa under Subclass 489 is a temporary visa appeal that consists of three ways for skilled workers looking to work and live in Australia. This approach falls under the points-tested stream as well and is an alternative option for individuals willing to reside in Australia who possess certain skills relevant to be qualified for this visa. The 489 visa is not a permanent residency visa but gives applicants the chance to live and work in Australia for up to 4 years. Although the general criteria of application may appear similar to other visa types under the points-tested stream, the most distinct factor of this three-way visa appeal is that an individual must either receive an invitation from the Department, hold a previous Skilled Regional visa, or have a family member who holds a certain class of visa to be eligible to apply. Since it is a provisional visa, individuals who are granted their appeal are restricted to a certain area to live and work which depends upon the basis of their application. If an applicant is nominated by the State/Territory, s/he must work and live in a regional or a metropolitan area nominated by the State/Territory, that has low-population growth. If an applicant is sponsored by a family member, s/he may work and live in the Designated Areas of any State or Territory.

The State Nominated Visa under subclass 190 is significantly similar to the 189 visa in a lot of ways but it has some distinctive points that make it a unique visa appeal. It is a points-tested visa appeal that allows skilled workers to obtain permanent residency in Australia. An individual must have assessed skills in an occupation included in the Skilled Occupation List (SOL). Similar to the 189 visa, an EOI has to be lodged initially to begin the visa appeal procedure. Applicants can be inside or outside the Australian territory while making the application. The major point that differentiates this visa from the 189 visa is that the candidate has to be nominated by the State or Territory Government to apply for the 190 visa. The eligibility criteria to apply for this visa, entitlements received with the approval of the application, and procedure to lodge the visa application are all constant with the Skilled Nomination Visa under Subclass 189. Additional requirement for the 190 visa The most evident requirement due to which the 190-visa appeal becomes unique is the necessity to be assessed and invited by the State or Territory Government in order to apply. In the 189-visa appeal, no additional nomination by any Governmental body is required but it is crucial that the government must nominate you to proceed further in this appeal. After the submission of an EOI in SkillSelect, the Australian State or Territory Government may nominate you for this particular visa appeal and you can move forward with lodging an application after that invitation. Withdrawal of nomination by the government after you have applied makes your application invalid. All state and territory government agencies have their own criteria for deciding whom they will nominate.
