The Partner (Provisional) Visa (Subclass 309) is a temporary visa that lets offshore applicants who are de facto partners or spouses of an Australian citizen, Australian permanent resident or eligible New Zealand citizen live in Australia temporarily. This is the first stage in the two stage partner visa appeal and also the first step towards a permanent Partner visa (Subclass 100). This visa allows you to stay in Australia temporarily until the Australian government has decided the outcome of the permanent stage Partner (Permanent) Visa (Subclass 100) of your visa application.
Eligibility criteria for a Partner (Provisional) Visa under Subclass 309
- You must be outside Australia at the time of applying.
- You must be in a genuine relationship with an Australian citizen, permanent resident, or eligible New Zealand citizen who is willing to sponsor you.
- You must meet the requirements for a “de facto” partner if you are not married.
- You must be over 18 years of age (except in particular circumstances.)
- You must meet all health and character requirements.
- You must have no outstanding debts to the Australian government.
- You must not have had a visa canceled or application refused.
Privileges linked with Partner (Provisional) Visa (Subclass 309)
- Right to remain in Australian until a decision has been made about your permanent Partner visa.
- Allowed to work in Australia.
- Allowed to study in Australia, but with no access to government funding for tertiary study.
