Partner Visa (Temporary) (Subclass 820)

The Partner Visa (Temporary) under Subclass 820 is a temporary visa that lets onshore applicants who are de facto partners or spouses of an Australian citizen, Australian permanent resident or eligible New Zealand citizen live in Australia temporarily. This is the first stage in the two stage partner visa appeal and also the first step towards a permanent Partner visa (Subclass 801). This visa allows you to stay in Australia temporarily until the Australian government has decided the outcome of the permanent stage Partner Visa (Permanent) (Subclass 801) of your visa application.

Eligibility criteria for a Partner Visa (Temporary) under Subclass 820

1. You must be inside Australia at the time of applying.
2. You must be in a genuine relationship with an Australian citizen, permanent resident, or eligible New Zealand citizen who is willing to sponsor you.
3. You must meet the requirements for a “de facto” partner if you are not married.
4. You must be over 18 years of age (except in particular circumstances.)
5. You must meet all health and character requirements.
6. You must have no outstanding debts to the Australian government.
7. You must not have had a visa canceled or application refused.
